The relationship between parents and children according to the new National Civil and Commercial Code

This research work has as a main objective the analysis of the legal frame regarding the parents-children relationship agreeing to the regulations of the Civil and Commercial Code and its application into everyday judicial practice. This implies the need of the deep and profound study of family conflict in order to analyze the new normative in “parental responsibility”, in agreement with the doctrinaire and judicial evolution which has left behind the substituted notion of “patria potestad” by the notion of “integral protection”. In such way, the main purpose is to highlight the importance that the family conflict be treated by a specific process, attending to its particulars and special nature.
Finally, and considering the duties of the co-paternal right emphasizing the notion of personal care, the objective is to highlight the importance of the judge´s labor when proposing a “work plan” in the cases submitted to its decision; considering, in the first place, to the conflict own-composition, and just then, solve the parental disagreement. All this, in a permanent consideration that in all cases it must be arrived to a right constitution of the parental couple and, consequently, to the shared personal care.Downloads
